General Terms of Use

Company Identity

These General Terms and Conditions describe the terms and conditions for all services provided by the anonymous company under the name “BURRAQ TRAVEL & TOURS GENERAL TOURISM OFFICE ANONYMOUS COMPANY” and the distinctive title “BURRAQ A.E.”, headquartered in Athens, Menandrou Street No. 58 and Xouthou, with Tax Identification Number (TIN) 998912520 and General Commercial Registry (GEMI) number 008408601000 (hereinafter referred to as “the Company”) and the “SIM READY” application (hereinafter referred to as “the Application”), which the Company developed for the resale of prepaid e-SIMs.

SIM READY is the electronic application for the resale of prepaid e-SIMs over the internet, created by the Company. Simultaneously with the Application, the Company maintains a website (www.simready.gr  ), which informs customers about the existence of the Application, redirects customers to the Application, and includes answers to frequently asked questions that may arise for customers. Products and services of the Company are not available through the website.

The Company has set as its primary goal the best service and satisfaction of customers who will use the Application by creating and fostering a climate of trust.

It is important for us that users are always informed and secure, and for this reason, we consider it our obligation to inform them about the following terms of use and conditions.

Introduction

The use of the Application is governed by these terms and conditions, which users are called upon to read carefully and comply with. The Company considers that customers have read carefully and have been informed of the General Terms and Conditions before using the Application. By entering the Application, the customer is deemed to have been informed of the General Terms and Conditions, to accept them, and to waive any claim that may arise from the use of the Application, as the use of the Application implies explicit and unreserved consent and agreement to the specific terms and conditions. All transactions conducted through the Application are governed by Greek and European law regarding electronic commerce, as well as consumer protection legislation, regarding the sale of goods and the provision of services.

The Company reserves the right to modify or update the terms and conditions of transactions without notice, and undertakes the obligation to inform consumers through the Application and/or by any other appropriate means, of any change, modification, or addition made.

The invalidity of any terms herein does not entail the invalidity of the remaining terms. The non-exercise by the Company of any rights under these Terms and Conditions does not imply a waiver of these rights. The Company is not liable for any breach of these Terms and Conditions due to force majeure, such as extreme weather events, earthquakes, floods, fires, states of emergency, etc.

Personal Data Protection

The protection of your personal data is important to us. Our goal is to be as honest and transparent as possible regarding the personal data we collect and how we process it. Our Company fully shares the concerns of its customers regarding personal data.

The Company resells prepaid e-SIMs through the Application. The Privacy Policy explains the types of personal data processed by the Company, how it is processed, and the purposes of processing. In the Privacy Policy, you can also find details about the processing of personal data for specific services we provide, for which additional relevant information is provided. The Privacy Policy applies to every interaction you have with the Company.

Personal data is data that can be used to identify a natural person. You may be asked to provide personal information in the context of any communication, transaction, and in general any interaction with the Company.

We ensure that we collect only the absolutely necessary data, which is appropriate and clear for the intended purpose.

The collection and, in general, processing is done for various purposes, which are described in the Privacy Policy. Among these purposes is our effective operation and to provide you with the best experiences with our products and services. Some of this data is provided directly by you when, for example, you create an account in our Application, or when you purchase a service or communicate with us.

We rely on various legal grounds and rights (“legal bases”) for processing data, such as your consent, our legitimate interests, the need to enter into and execute contracts with you, as well as compliance with our legal obligations, for various purposes described in the Privacy Policy.

Also, we may obtain data from third parties. We protect the data we receive from third parties in accordance with the practices described in the Privacy Policy, as well as any additional restrictions imposed by the data provider.

When you are asked to provide personal data, you may refuse. However, some of our services require some of your personal data in order to respond and provide you with the service. If you choose not to provide data that is necessary for the operation and provision of a service to you, you will not be able to use the specific service. Similarly, in cases where we are required to collect personal data by law or for the purposes of entering into or executing a contract with you, and you do not provide your personal data, we will not be able to enter into and execute the contract.

It is expressly stated that specifically a) for your identification as mobile phone subscribers and b) for your service in case any issue arises during our cooperation, the role of Data Controller is held by Vodafone-PANAFON A.E.E.T., and we act as the processor on its behalf.

As the Data Controller, our Company acts ONLY for the User Data it holds in your profile (name, nationality, date of birth) and for the processing of your payment details.

Simultaneously with the Application, the Company maintains a website, which informs customers about the existence of the Application, redirects customers to the Application, and includes answers to frequently asked questions that may arise for customers. Products and services of the Company are not available through the website.

Intellectual Property

All content of the Application and the website, including images, photos, graphics, texts, and generally all files, constitute intellectual property and trademarks of the Application, the website, and the Company, and are protected by the relevant provisions of Greek and European law. Any copying, modification, alteration, adaptation, reproduction, distribution, transfer, sale, republication, transmission of data in any way and any information (in whole or in part) provided in the specific Application or the specific website by any means or method, without the prior written permission of the Company, is prohibited.

Account Creation — Identification Process of Natural Persons – User Obligations

The Company resells prepaid e-SIMs with data packages and data and voice packages. The user, in order to purchase the e-SIM, needs to enter the Application or the Company’s website, through which they are redirected to the Application.

The user must accept the General Terms and Conditions for the use of the Company’s services, as mentioned above. Upon entering the Application, the user registers their email address, to which a confirmation link (email verification) is sent. After confirming the email address, the user sets a passcode, which is a six-digit personal code, which the user will use in the future to log in to the Application after completing the registration process and for critical actions they will take while using the Application.

To complete the user’s registration, the user must provide the data (i.e., their full name, contact phone number, date of birth, and nationality), which the Company will process and store in accordance with the provisions of the Privacy Policy. All provided data must be complete, accurate, true, and up-to-date.

Furthermore, both for compliance with applicable legislation and for security reasons, with the aim of verifying the user’s identity in certain cases (e.g., for data and voice packages) and always with the explicit consent of the user according to Article 9 par. 2 lit. a of the GDPR, remote electronic identification of the user takes place using biometric data (facial characteristics) through SumSub (https://SumSub.com/) and the User Verification Process. The verification of the user’s identity is done in a short time, by providing identification documents (e.g., ID cards, passports, driver’s licenses, etc., which include information such as the type of identification document, the number, the country of issue, the date of issue and expiration, the nationality and age of the user, and other information) and taking photos (selfies). The biometric method used consists of verifying your identity through automated analysis of the photo and comparison with the photo of your identification document. In case the result of the remote electronic identification process requires the intervention of a natural person, a responsible person from the service office contacts the user via video call. The user is immediately informed of the result of the identification process. The above identification process does not need to be followed if the user chooses only data packages (only data).

The user account remains active until the user themselves deletes it and in any case after a period of three years of inactivity, which justifies its deletion. In case of account inactivity, before the account is deleted, the user will be sent two informational emails.

Furthermore, it is noted that the user account is personal and non-transferable. For this reason, the user is solely responsible for any use and activity that takes place through their account and with their passcode. The user is responsible for maintaining the confidentiality of their account and passcode, as well as for restricting access to their account from any other party. To protect the account, the user must keep their passcode confidential, not reuse it in other services. Also, they must immediately notify the Application and the Company of any unauthorized use of their account or passcode, for any (even potential) security breach, as well as for the actual loss or theft of the device on which the e-SIM is installed. The Company is not liable for any damage or loss that may arise from the unauthorized or illegal use of the passcode by third parties, due to its leakage or for any other reason, and reserves the right to claim compensation from the user, in case it suffers any kind of damage from the unauthorized or illegal use of the passcode. The Company reserves the right at any time to refuse to issue a passcode or to cancel an issued passcode or to terminate the provision of these services to the user and to refuse any current or future use of the Application, in case of violation of the General Terms and Conditions.

The user accepts, agrees, and acknowledges that they will make lawful and appropriate use of the Application. Therefore, the user indicatively and not exhaustively agrees that they will not use the Application to:

  • Cause harm to a minor.
  • Transmit or access content that: (a) violates any third-party rights (e.g., intellectual and industrial property rights), (b) offends the personality of third parties (e.g., defamatory, racist content), (c) is contrary to law and good and transactional morals, (d) in any way harasses the private life and the individual and social rights of third parties.
  • Mislead anyone regarding the origin of the content of the Application.
  • Damage, in any way, the reputation of the Application and the Company or third parties.
  • Endanger network security.
  • Prevent any user from accessing the Application.
  • Bypass identity verification.
  • Install and promote, in any way, any kind of unsolicited or unauthorized advertising or unsolicited electronic messages (spam), chain letters, pyramid schemes, and any other form of unwanted content promotion, as well as install and promote advertisements without the written consent of the Application.
  • Install, promote, or make available content that contains digital viruses or any other electronic code, files, or programs designed to interfere, destroy, or limit the functionality of any software or telecommunications equipment or to prevent other users from using the Application.
  • Disclose information of their own or third parties that contain personal data of users or third parties either in real-time conversations or during the use of any service of the Application that provides the possibility of communication of more than two users.

In any case of illegal or contrary to these General Terms and Conditions use of the Application, the user is obliged to compensate the Company for any positive and consequential damage. The non-exercise by the Company of any rights under these General Terms and Conditions does not imply a waiver of these rights.

Provision of Services

After the user enters the Application, access is provided to the services and products, which consist of data packages or data and voice packages. More specifically, these are: (i) data packages that include data of a specific volume and for a specific period, as determined during the purchase or renewal process, and (ii) data and voice packages, which include a specific volume of data and a specific talk time for a specific period, as determined during the purchase or renewal process. Our services are provided after the installation of the e-SIM and the activation of the relevant program/package. The duration of our services corresponds to the terms described in the program/package purchased. The provision of services is completed with the full consumption of the program/package or with the expiration of the specified duration.

Our services are provided in cooperation with the anonymous company under the name “VODAFONE PANAFON ANONYMOUS GREEK TELECOMMUNICATIONS COMPANY” and the distinctive title “VODAFONE-PANAFON”, headquartered in Chalandri, Attica, Tzavella Street No. 1-3, postal code 15231, with Tax Identification Number (TIN) 094349850 and General Commercial Registry (GEMI) number 000828201000, and in cooperation with our Technological Partner, namely the private capital company under the name “LOGICEA GREECE DEVELOPMENT SERVICES SINGLE-MEMBER PRIVATE CAPITAL COMPANY” and the distinctive title “LOGICEA GREECE M.I.K.E.”, headquartered in Chalandri, Attica, Papanikoli Street No. 22A, postal code 15232, with Tax Identification Number (TIN) 801328146 and General Commercial Registry (GEMI) number 154504403000.

The Company reserves the right to limit the availability of its services in specific countries.

To use the provided services, the user needs to have an unlocked device, compatible with e-SIM and compatible with the network. An indicative list of devices compatible with e-SIM is provided: (www.simready.gr/esim-compatible-phones).

When using the provided services, the user must comply with the applicable laws and regulations of their country of origin or residence or temporary residence.

Commencement, Duration, and Termination of the Contract

The service provision contract between the Company and the user begins with the completion of the order in the SIM READY Application. The user must proceed with the activation of the e-SIM. The contract is automatically terminated if the user does not have an active data package or an active data and voice package or if they delete the e-SIM from their device. That is, after the exhaustion or expiration of the data program or data and voice program purchased by the user, the latter cannot use the provided services until the purchase of a new program.

The Company may terminate the contract before the exhaustion or expiration of the data package or data and voice package purchased by the user, if the latter violates the General Terms and Conditions. On the other hand, the user may terminate the contract at any time, by notifying the Company by sending an email from the email address declared during the activation of their account, to the following email address: [email provided]. If the termination takes place before the exhaustion or expiration of the data package or data and voice package purchased by the user, for a reason not attributable to the user but related to the provided services (e.g., permanent technical problem, which cannot be resolved), the user may request a proportional refund of the value of the unused services.

Furthermore, the provided services may be temporarily suspended: (i) for reasons of upgrade, modification, maintenance, (ii) if the user violates the described General Terms and Conditions, (iii) if an investigation is pending against the user, following a complaint and intervention by the competent administrative and judicial authorities, (iv) if the user fails to provide the required information necessary for compliance with regulatory provisions, (v) in case of fraudulent or illegal access, (vi) to prevent network damage caused by the user or their account, (vii) for reasons of emergency and security, and (ix) for any other legal reason, even if not explicitly mentioned herein. In case of suspension of the provided services, the Company will minimize the suspension time as much as possible.

Charges and Payments

The Company offers various payment methods for its services, including indicatively credit/debit card, PayPal, Google Pay, Apple Pay.

Payments are made in euros (€) as well as in other currencies, which are determined during the transaction.

Transactions are processed and secured by the secure encrypted environment of a financial institution approved by the Company, Stripe (https://stripe.com/) and are protected by top online security systems, which guarantee a secure transaction environment. The card charge is made after checking its validity, verifying its details, and the availability of balance. In case the transaction is rejected by the financial institution, then the purchase is not completed and the order is automatically canceled.

The Company declares that all prices and charges include value-added tax (VAT) and any other sales tax, duties, or contributions imposed by any authority, government, or government agency. For all transactions, a receipt or service invoice is issued.

Users cannot offset any claim they have against the Company, arising from any cause, with the Company’s claims against them, which arise in the context of the said service provision contract, unless the users’ claims are certain and settled or have been finally adjudicated by the courts.

Users will see the purchased e-SIM in the SIM READY Application. Also, users will receive a relevant confirmation email after the purchase. All information regarding the installation of the e-SIM is available in the user’s account in the Application.

Refund / Cancellation / Modification Policy

The customer has the right to request a refund or replacement of the e-SIM, if the latter cannot be installed and used due to a technical problem.

Refunds and Cancellations: A refund request can be submitted within thirty days from the date of purchase of the e-SIM, when activation is no longer possible after extensive collective handling of a technical problem. Cooperation with the customer is required for the timely resolution of the issue for the granting of a refund. Once the user installs the e-SIM, it will be considered that they have used it, resulting in no possibility of a refund.

Each data package or data and voice package has its own validity period. Therefore, a refund is not possible after the expiration date of the validity period of the said package.

The Company reserves the right to refuse any refund request, if there are indications of abuse and violation of our Terms and Conditions, as well as indications of any other illegal or culpable action related to the use of the Company’s products and services.

Incorrect Charges: If the user reasonably and in good faith disputes a charge, they must immediately notify the Company, providing details of the reasons why the charge amount is incorrect and, if possible, specifying the amount they consider as owed.

If the refund request does not fall under any of the above categories, it will be investigated on a case-by-case basis. If the refund is approved, a processing fee may apply. The maximum credit refund for which a user can apply must be equal to or less than the total amount paid.

Refund Process: To request a refund, contact our support team: (i) via live chat with our digital assistant (chatbot), which can automatically process your request or provide you with instructions for technical support issues, etc., and in any case with an authorized representative of ours, or (ii) by sending an email to the following email address: [email provided]. Depending on the nature of the problem, users will be asked for further information to support their refund request, such as screenshots of the device settings for technical issues or details of the reasons why the invoiced amount is incorrect and, if possible, how much the respective user considers as owed, etc.

If the request is accepted, the money will be refunded using the same payment method used for the payment. The estimated processing time for the request is thirty working days, after its processing.

Modification: Data packages and data and voice packages are offered by SIM READY as is and cannot be modified or adapted after their purchase, based on individual user requests.

Prices and Offers

The Company’s pricing and promotion strategies are designed to offer maximum value to our users, ensuring the sustainability and quality of the services we provide.

The Company reserves the right to adjust prices without prior notice to users. The Company continuously reviews its pricing strategy to align with market dynamics, ensuring that we provide quality services at competitive prices. Similarly, the Company reserves the right to adjust prices taking into account various factors, including, indicatively, market conditions, exchange rates, and operating costs. Such adjustments are made to ensure the sustainability of the services offered and to offset the cost of providing high-quality connectivity solutions to our users.

The Company is committed to making every effort to timely inform users of any significant changes in its pricing policy, allowing users to make informed decisions about their purchases. However, due to the dynamic nature of the factors affecting pricing, it may not always be possible to provide immediate notice.

We encourage users to visit our website and Application frequently for the most up-to-date information on prices and offers.

The Company reserves the right to offer promotional packages for a limited period of time in relation to the already provided data packages or data and voice packages. These offers are subject to specific terms and conditions. The duration of the promotional packages, the eligibility criteria, and the relevant terms will be clearly communicated during the promotional period. After the expiration of the said period, the normal charges will apply. The Company reserves the right to modify or terminate some or all of the promotional prices, including the relevant terms and conditions, at its absolute discretion, without prior notice to users. Disclaimer of Liability

The Company is not liable for any damages arising from the non-continuous availability of the provided services. The Company does not provide any guarantee for the continuous availability of network services.

It is noted that there are inherent risks in using, transmitting, or retrieving any data and/or content on the internet, and we urge you to ensure that you understand these risks before using the Application, the website, and our services. The Company disclaims any liability for the behavior of users and/or visitors when accessing or using its services and does not provide any guarantee regarding the Application, the website, their content, and services. The use of the Application and the website is at the users’ responsibility.

To the extent permitted by law, the user agrees to release the Company from any liability for any reason, for any possible damage, including, (indicatively), any direct or indirect damage, loss, or expense: (a) that is due or in any case results from the use of the website, the Application, their content or services or related linked websites or applications or conversely from the inability to use them, or (b) is related to any malfunction, error, omission, interruption, defect, delayed operation or delayed transmission, computer virus or system or line malfunction, even if it knew of the possible occurrence of such damages, losses, or expenses.

Dispute Resolution

Any dispute arising in relation to the General Terms and Conditions shall be governed by Greek law and the jurisdiction of the Courts of Athens, unless other mandatory rules apply.

Furthermore, regarding your personal data, you can contact the Data Protection Authority, which is headquartered in Athens, Kifissias Avenue 1-3, postal code 115 23, tel: +30 210 6475600, which oversees the application of the General Data Protection Regulation, laws 4624/2019 and 3471/2006 of the Greek Parliament, and other regulations concerning the protection of the individual from the processing of personal data.
